A recent change made by the Northern Ireland Health Minister, Robin Swann, to rules regarding paying for Care means that many more people will now be immediately liable for their own Care fees.

The new test for establishing whether the patient or the Health Trust pays for ongoing Care costs is now contained in one sentence –

“Can your Care needs be properly met in any other setting other than a Hospital?”

If the answer to this is ‘No’ then the person is clearly ill enough to have to remain in hospital for ongoing care by doctors/surgeons etc and thus no fees are payable.

If the answer is ‘Yes’ then the person is immediately responsible for their own care costs if they have assets valued in excess of £23,250. They will part pay, along with the local Health Trust, if the value of their assets sits between £14,250 and £23,250 – only when assets are valued at under £14,250 will the Health Trust fully fund their Care costs.

In another twist to the new rules, it appears that people can no longer apply for Continuing Health Care packages, for example, to help with the cost of end-of-life care for terminally ill relatives. It also means that the ‘nursing care’ cost of around £100 per week, previously covered by the local Health Trust, is now also payable by the patient on top of the ‘residential’ cost of the Care Home.

With these new rules already in place it has never been more important for people in Northern Ireland to put in place suitable planning, well in advance of any Care needs being established, to ensure that their hard-earned assets are protected for themselves and their families no matter what happens in later life.
