What is an Enduring Power of Attorney?
What is an Enduring Power of Attorney?
This is where you appoint someone you trust, to act on your behalf in relation to your property and financial affairs, should at any point you lose mental capacity.
This can happen by way of an accident or perhaps the early onset of dementia. The only alternative, if an Enduring Power of Attorney (EPA) is not in place, is to apply for Controllership through the High Court. This can be a very lengthy process which can take up to 3 years to complete and it is also very expensive, costing several thousand pounds. During this time, your bank accounts will be frozen, properties cannot be sold, and it can leave you with many financial burdens.
We highly recommend to all our clients that they have an EPA in place, in order to prevent the above situation from happening.
